While it is intended for sellers of real estate in Montana, i.e. it sets forth the selling process under Montana laws, you may find it of value regardless of where you are selling real estate. This is a Continental Crown Memorandum written for the benefit of the Associates of the brokerage. It is very beneficial in helping to understand the process Buyers must undertake to get financing for the purchase of property. We encourage our Clients to begin this process of getting Pre-Qualified and then Pre-Approved with the lender of their choice even before meeting with a Realtor® to begin the process of finding a suitable property that meets their criteria.
Federal law requires that home buyers be provided a copy of the lead based paint brochure if they are contemplating purchasing a home built prior to 1978. Lead has been demonstrated to be harmful to one's health, particularly that of children. As a result, the manufacture of lead based paint was banned as of 1978. However, lead based solder was used in copper plumbing for some time after that date, and amy also be of concern. Federal and state laws require that all home buyers and sellers abide by fair housing and non-discrimination practices. No party in any transaction involving real estate may discriminate against any other party based on race or color, national origin, religion, sex, familial status, or handipcap (disability). Continental Cronwn strongly supports these laws, and encourages everyone to also practice non-discrimination and fair housing in real estate. The following list of documents is offered to give the Buying or Selling Client some idea of the many documents that may be required in any given transaction. By no means does this list include all the many documents that might be required for any given transaction, as every property and its associated paperwork are uniquely different.
The document you will find in the following are Continental Crown versions of contracts and disclosures you will perhaps encounter as you buy or sell property in Montana. However, when you use a Realtor®, you will be utilizing forms prepared by and approved for use by the Realtor® organization. As they are copyrighted documents, we cannot post them here for your perusal, but are instead offering a version we may use as we hold the copyright to these documents. In the Realtor® world, some of the documents we present as separate items may be combined into one which covers a number of topics. Neither approach is better than the other; we are presenting them as separate items so you might better understand WHY and WHAT the purpose of the document is in the process of moving a transaction along.
